These Terms of Use (“Terms/Terms of Use”) govern your use of the websites, mobile application, content and community services offered through https://www.kavaxsecurity.com, other websites, and the mobile application with the name of ‘Kavax’ available on the Android Playstore and Apple App Store (“Site”) owned by Kavax (VPN Digital Service Pvt. Ltd.), its subsidiaries, affiliates or its group companies (“Kavax” or “We” or “Us” or “Our”) or any mobile or internet connected device or otherwise, including any content functionality and services offered on or through the Sites (the “Service”). By accessing the Site or Service and/or by clicking “I agree”, you agree to be bound by these Terms. The term ‘kavaxsecurity.com or ‘Kavax” is used through this entire Terms of Use document to refer to the Site, Kavax and the employees and associates of Kavax.

These Terms constitute a legally binding agreement between you and Kavax. You acknowledge and agree that by accessing or using the Site you have agreed to bound and abide by these Terms and our privacy policy available at kavaxsecurity.com/privacy-policy (“Privacy Policy”).

INTELLECTUAL PROPERTY & NO RETRANSMISSION

All information available on the Site is the proprietary, confidential property of Kavax and cannot be repeated for any reason outside the Site. You will not resell, reverse engineer or adapt the Site without prior written consent.

INTERMEDIARY DECLARATIONS

It may be submitted that Kavax is a brand owned by VPN Digital Service Pvt. Ltd., a company duly incorporated under the Indian Companies Act. The company is an intermediary under Section 2(1)(w) of the Information Technology Act 2000. The company is a network service provider and has exercised due diligence while discharging its obligations. Kavax has complied with the provisions of the Information Technology Act 2000, the IT (Amendment) Act 2008, the IT Rules 2011, and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021.

UNPERMITTED USE OF THE SITE AND SERVICES

You agree not to:

• Use the Site for commercial resale, scraping, or surveillance.
• Upload or transmit malware or harmful code (other than for the purpose of virus scanning services).
• Access data of other users without authorization.
• Infringe copyright or privacy of others through your use of the Site.

SUPPLEMENTAL TERMS FOR INSURANCE

Please note that Kavax is merely a facilitator and does not endorse or promote cybersecurity insurance. We are neither an insurance broker nor a registered third party acting as an intermediary between you and the insurance company. You are required to pay all the premiums and costs in relation to your cybersecurity insurance policy to the third-party insurer. Kavax is not responsible for any claims made by you under the cybersecurity insurance policy or responsible for settling, facilitating or assisting you in this regard.
